Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Frequensea mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Frequensea ("Company," "we," "our," or "us"). We reserve the right to update these Terms at any time, and your continued use of the Service after any changes constitutes acceptance.

2. Description of Service

Frequensea is a wellness application that provides personalised affirmations, guided sound frequency sessions, sacred rituals, dream journaling, morning reflections, and related mindfulness tools.

The Service is not a substitute for professional medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions you may have regarding a mental health condition.

3. User Accounts

To access most features of the Service, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials and not share them with others
• Notify us immediately at legal@frequensea.app if you suspect unauthorised access
• Be solely responsible for all activity that occurs under your account
• Be at least 13 years of age (or 16 in the EEA) to create an account

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise harm the Service or other users.

4. Subscription and Billing

Subscription Tiers

Frequensea offers three subscription tiers in addition to a free "Shore" plan:

• Shore (Free) — core affirmations, basic session access, and daily rituals.
• Depths — full Solfeggio frequency library, Sacred Rituals, complete session history, and Ocean Wrapped reports.
• Abyss — all Depths features plus AI voice alarms, voice cloning, and priority support.

Subscriptions are available on monthly or annual billing cycles. All subscriptions are processed through Apple App Store or Google Play via RevenueCat.

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Apple ID or Google Play account settings.

Refund Policy

We offer a full refund within 14 days of your first purchase of a given subscription tier if you are not satisfied, provided you have not used more than a reasonable amount of the premium features. After 14 days, no refunds will be issued for the current billing period. Refund requests must be submitted to legal@frequensea.app. Refunds for purchases made through the App Store or Google Play may be subject to their respective refund policies.

5. Content and Wellness Disclaimer

All affirmations, guided sessions, ritual content, and frequency information provided through the Service are for general wellness and personal development purposes only. They are not intended to constitute medical advice, clinical therapy, or any form of professional healthcare.

• Affirmations and ritual content are tools for personal reflection and motivation, not therapeutic interventions.
• Solfeggio frequencies are presented as wellness audio; claims about their physiological effects are not clinically validated and should not be construed as medical claims.
• AI-generated content may occasionally contain inaccuracies or outputs not suited to your circumstances.

6. User-Generated Content

You retain ownership of all content you create within the Service, including journal entries, reflections, and voice recordings ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit that content solely as necessary to provide and improve the Service.

You agree not to submit content that is unlawful, harmful, harassing, defamatory, or otherwise objectionable. We reserve the right to remove any User Content that violates these Terms.

7. Intellectual Property

The Service and all of its original content (excluding User Content), features, functionality, branding, and technology are the exclusive property of Frequensea and its licensors. This includes the Soul Quiz methodology, affirmation copy, ritual scripts, and the app's source code.

You may not copy, reproduce, distribute, modify, or otherwise exploit any part of the Service without our express written permission.

8. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any portion of the app
• Circumvent subscription paywalls or entitlement checks
• Use voice cloning features to impersonate others or create deceptive audio content
• Scrape, harvest, or collect data from other users without consent

9. Termination

You may stop using the Service and delete your account at any time through the app settings. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or permanently terminate your access to the Service, with or without notice, if we believe you have violated these Terms or engaged in fraudulent or abusive behaviour.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Frequensea and its officers, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.

Our aggregate liability to you for all claims shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim or (b) USD $50.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, you agree to binding arbitration conducted by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide reasonable notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an in-app notification or email.
